SUPERVISOR REPLACEMENT PETITION: On July 21, 2008,  we finished a test printing of the prototype petition and submitted it our attorneys for an opinion. On July 22, we were told that there are still some minor legal problems with the wording on the form and this will require more research into case law and editing before we can print and distribute the forms for signature. We have been assured that every effort will be made to have the finished forms available sometime the first of next week. We believe that we will have the finished edited forms by Monday, July 28. If we receive the approved forms in a timely manner on the 28 th, we will make every effort to have forms printed by Tuesday, July 29. 

We are encouraged by the fact that our attorneys caught the errors before the petitions were printed and distributed for signature. It is amazing that the Commonwealth of Virginia has never published a standard county supervisor replacement petition for the citizens to use in a case such as this one. We hope you can appreciate the fact that this a very unusual legal process and that we are trying very hard to get it right so please do not loose hope or become disappointed.

CORRESPONDENCE FROM THE REGISTRARS OFFICE:  We received the following information today:

 Section 24.2-233 states as follows: The petition must be signed by a number of registered voters who reside within the jurisdiction of the officer equal to ten percent of the total number of votes cast at the last election for the office that the officer holds.” For your information, the most recent votes were:

            2005 – York District Supervisor:                       1657 total votes cast

            2007 -  Gloucester Point District Supervisor:  1679 total votes cast

            2007 -  Ware District Supervisor:                      2092 total votes cast

            2007 -  At-Large District Supervisor:                9139 total votes cast

From the above statement we can conclude the minimum signatures required to remove the supervisors from office would be.

York District                          166

 Gloucester Point District     168

Ware District                        210    

At-Large District                   914

To remove the supervisor representing your district you must be a registered voter in your district and you can only collect signatures from other voters in your district.

Any registered voter in any voting district can collect signatures from any registered voter in any other voting district to remove the At-Large District Supervisor from office.

If you are circulating petitions you will need two petitions. One for your district and one for the At-Large district Supervisor. If you are signing petitions, please make sure you sign both of them.
